Regulations for Photo Shoot

Clients booking a photo shoot declare that they have familiarised themselves with the portfolio, the style of the photographs presented, their graphic, in-house photo processing and fully accept it.

The Client receives exactly the number of photographs he/she purchased in the particular package shown on the website. There is no possibility to receive the „rest” of the digital photos – raw/ or after digital processing for free. It is possible to purchase additional shots outside the package.

The Regulations of photo shoots at Paulina Smile Photography studio is a binding document with which the Client is obliged to familiarise himself/herself prior to the photographic service when booking an appointment. Its disregard, failure to read and familiarise themselves with its contents does not release the Client from the consequences it entails.

Knowing the studio’s Regulations and knowing how to carry out the photo shoot is a guarantee of successful photos, mutual satisfaction and our holy peace of mind 😉 Formalities are disliked by most of us, but in order to comply with the law, to protect myself as a creator-photographer, but also You, the Clients, please read the following Regulations.

The following Regulations are based on the desire to spend a pleasant time with you, without haste, insinuations or lost respect. Thanks to you, I can develop and create exceptional photographs, so let’s prepare together for the photo shoot as well as possible.

The photo shoot is divided into individual stages:

  1. Booking a photo shoot
  2. Photo shoot with payment on the day of the appointment
  3. Photographer’s choice of photos for the Client
  4. Selection of photos by the Client
  5. Photo processing and retouching
  6. Downloading of digital photos + possible collection of ordered prints

PHOTO SHOOT BOOKING

  1. A Client books the date by paying a deposit which is deducted from the amount of the selected package.
  2. Prior to each photo shoot, the Client is required to read the Regulations and provide their name, email address needed to submit images for selection. By providing the data, the Client accepts the following Regulations.
  3. By agreeing to participate in the photo shoot, the Client declares that he/she has familiarised himself/herself with the Photographer’s portfolio, accepts the presented style of work, type of frames, aesthetic sense and post-production techniques in graphic programmes (e.g. sharpening, light colouring of studio photographs, blurring of the background), which releases the Photographer from additional corrections and possible claims after the handover of the finished photographs, unless he/she decides otherwise.
  4. The Client is aware that the Photographer does not shoot in the likeness of another Photographer’s style.
  5. The Photographer does not perform photomontages and does not sell photographic products that are not in his/her sales offer.
  6. The Client is aware that each shoot is taken under different conditions, so the Photographer is not able to perfectly reproduce a photo he/she has previously taken, which can be viewed in his portfolio.
  7. Shoot bookings can be made by phone or electronically via Facebook message or through the Mafelo website.
  8. Prior to the photo shoot, you must inform the Photographer of the package you have chosen and communicate any comments and expectations, which must be confirmed by the Photographer.
  9. The packages shown in the offer are basic packages which cannot be reduced. Cancellation of any element of the package does not reduce its price.
  10. A pet may be brought to the shoot after informing the Photographer in advance. The Client is responsible for any damage caused by the pet’s presence.
  11. The Client has the right to reschedule once up to 24 hours before the photo shoot. Cancellation of the photo shoot 'through the fault’ of the Client involves loss of the deposit.
  12. Cancellation of a shoot from the voucher in the event of fortuitous events (e.g. illness) is possible only 24 hours before the appointment and with prior notice to the photographer, otherwise the voucher is forfeited (e.g. contact with the photographer e.g. 3 hours before the appointment).
  13. No refunds will be given to the person who purchased the voucher if the voucher is not redeemed within the validity period.

PHOTO SHOOT

  1. The photo shoot, depending on the arrangement with the Photographer, is done in the studio or outdoors.
  2. The duration of the photo shoot depends on the type of the photo shoot and the package chosen.
  3. The Client’s lateness will be deducted from the photo shoot time.
  4. The Client  must come to the photo shoot at the appointed time (the shoot time includes preparation, so there is no need to arrive much ahead of time).
  5. For the duration of the photo shoot, only the people taking part in the shoot + the children’s guardians stay in the studio.
  6. Prior to the photo shoot, the Client must agree or not, to the publication of your image. The provision does not apply to TFP shoots, where this is tantamount.
  7. It is forbidden to take photos with your own smartphone, tablet or camera during the photo shoot. Failure to comply with the above paragraph will result in the Photographer automatically terminating the photo shoot unless he/she has given permission.
  8. The Client is aware that the end result of the shoot is influenced, among other things, by his or her preparation (styling, make-up) and commitment when posing.
  9. Factors influencing the implementation of children’s shoots, i.e. the child’s age or disposition, the mood of the day, may result in the Client receiving images that may differ from those presented in the portfolio.
  10. TFP photo shoot – posing the Client in exchange for photographs. The photo shoot is offered by the Photographer for the purpose of expanding his/her own portfolio, testing studio scenes, etc. In the case of withdrawal of consent for the publication of photographs on the Internet by the persons taking part in the photo shoot, payment for the service takes place in accordance with the valid price list + possible studio costs incurred, e.g. make-up service, decoration, etc.

PAYMENT FOR PHOTOS

  1. Payment for the photo shoot takes place on the day of the shoot. This is a condition for handing over the secured photo gallery to the Client for post-production (graphic processing-retouching), which will be carried out next.
  2. Prices are not negotiable.
  3. Payment for additional shots can be made by bank transfer in accordance with the applicable price list.
  4. A fully paid order from the shopping cart with the extras included is queued up for processing work.
  5. Due to the individual nature of each photo shoot order, only price ranges are shown. A full quote for the shoot images will be provided once all terms and conditions have been agreed with the Client.

CLIENTS 'S CHOICE OF PHOTOS

  1. After the photo shoot, the Client receives access to the Client Panel, which contains all the shots taken during the shoot, either by email or FB message. The photographer has 7 days to do this.
  2. The Client has 20 days to select the best shots for further processing. After this time, the gallery will be closed and will not be accessed and the images will be deleted. The time for the Client to select the photos is related to the need to store the files on the computer disk, but should be as short as possible due to new orders coming in. If it is necessary to extend the access to the gallery for a longer period, it is necessary for the Client to inform the photographer of this, otherwise the order will be closed and not fulfilled through the fault of the Client.
  3. The Photographer digitally processes the confirmed order.
  4. The Client reserves the transfer of all photos taken during the photo shoot in RAW or JPG format before digital processing. The Client will receive a clearly defined number of images in accordance with the offer presented and the mutually agreed order.
  5. The Client agrees to the archiving, processing of photos and personal data and the uploading of photos to the Client panel, as well as to the uploading of photos for printing if necessary.
  6. Further work on the photos is only done by the Photographer by confirming and sending his/her order, and previously adding the photos to the shopping cart.
  7. Any suggestions for retouching (e.g. narrowing the face, enlarging the tummy for a pregnancy shoot) should be added in the Client panel in the option – comment on the photo.
  8. The cost of a digital photo outside the package is €10. Additional frames without processing for those willing only after exceeding the maximum packages in an amount to be determined.

POST-PRODUCTION – DIGITAL PROCESSING AND PHOTO RETOUCHING

  1. The Photographer reserves the right for the Client to carry out any independent processing and interference with the structure of the photographs, i.e. (change of colour, retouching, framing, application of filters – also on social networks such as instagram).
  2. The Client must not require complex graphic alterations concerning, for example, his appearance – e.g. nose correction, drastic slimming, ironing of clothes.
  3. The Photographer does not retouch unnecessary items of clothing or remove colourful stick-on tattoos on children, which need to be washed off before the shoot. In the studio we pose in bare feet or in altered clean shoes taken for the shoot, which will look good in the photos.
  4. The Client is aware that the finished digital images submitted for download will differ in colour from those received for watermarked – jpgs selection. The photos selected by the Client in RAW will undergo colour processing and retouching.

COMPLAINTS

  1. Once the digital photos have been accepted after processing, the Client will not make any additional claims upon receipt of the prints as to colour changes, retouching on paper photos, etc. unless these are obvious errors on the part of the laboratory. Any complaints and replacement of photos and printing of new photos – only after returning the prints that have been claimed.
  2. It is not possible to make a complaint about the shots based on the presented style of the Photographer (e.g. light studio colours) or to exchange the shots for other ones after the transfer of already finished ones. The Client, by agreeing to participate in the photo shoot, declares that he has familiarised himself/herself with the Photographer’s portfolio and accepts the presented style of work – 1.2.
  3. Any objections to the digital processing of the photos will be resolved personally with the person ordering the shoot within 7 days of the Photographer handing over the finished photos for download. Complaints about the photos by spouses, partners, persons only participating in the shoot will not be taken into consideration.
  4. The Photographer is not responsible for the quality of lighting indoors during reportage shoots, weather conditions and the involvement of models, lack of proper preparation – clothing, styling.
  5. The Photographer is not responsible for the lower technical and content quality of the photos in the event of obvious interference by third parties, e.g. family, priest, clergy person in the frame during reportage shoots.
  6. The Client is aware that reportage photographs may differ from those presented in the Photographer’s portfolio, which contains mainly studio photos – planned and styled, differing in the nature of documentation.
  7. If the Client is not satisfied with the submitted photos, additional processing and retouching of the photos „from scratch” is charged according to the applicable price list, unless the Photographer decides otherwise.

RECEPTION OF DIGITAL PHOTOS

  1. The finished photos are handed over to the Client after full payment has been made for the order.
  2. The maximum waiting time for images is 60 working days + time for the Client to select photos.
  3. Digital photos after processing are transmitted to Clients electronically via the Client Panel for download.
  4. It is not possible to receive the „rest” of the images without processing without payment.
  5. The Photographer does not burn the photos onto discs or other media. The photos are transferred to the Client via an individual download panel to their own computer at home.
  6. Prints are stored at the studio premises for 30 days after the Client has been notified that they can be collected. After this time they will be disposed of. The total cost of re-printing the products is paid by the Client.
  7. Consent to the publication of the photos (by the Photographer or lack of consent on the part of the Client) is voluntary, but the Client’s choice and submission of this information in the Mafelo panel is mandatory prior to the Photographer submitting the digital photos.

OTHER PROVISIONS

  1. The Client ordering photo shoot session is financially responsible for damage caused by children and adults, animals participating in the shoot (e.g. dirt, torn photographic backgrounds, damaged props, etc.).
  2. Hand disinfection, a change of footwear and outerwear are mandatory in the photographic studio.
  3. Children are left in the care of their parents, who are responsible for them while they play and while they pose for photographs, e.g. on the backdrop, bed or swing, at the kitchen buffet in the office.
  4. Parents shall ensure that children do not touch the photographic and lighting equipment, the background suspension system and other buttons under any circumstances.
  5. Any financial costs associated with the repair of photographic equipment or damage to materials used during the photo shoot, which are the fault of the parents or minors, shall be borne by the person commissioning the shoot.
  6. The props in the studio are not disposable items, nor included in the cost of the photo shoot.
  7. For security purposes, to protect the equipment in the event of theft or damage through the fault of the Client or to deal with complaints, there is 24-hour monitoring in the studio and building. The premises are visibly and legibly marked for

by means of a camera symbol and relevant information. The monitoring does not include the changing area for photos and the sanitary room.

  1. The Client’s participation in the shoot is tantamount to acceptance of the information contained on the page – Regulations.

I agree to: the processing of my personal data for the purposes necessary for the fulfilment of the order (accounting documents, ordering of prints, sending of photos of my choice). storage of my photos in places such as the Photographer’s computer, hard drives and external drives.

I have read and accept the Studio Regulations.

The contract is concluded for an indefinite period of time, i.e. the provisions concerning the use of the photographs, the manner of such use and copyright are not subject to time limits. In the case of disputes whose resolution goes beyond the goodwill of both parties, the provisions of the Civil Code of 23 April 1964 and the Act on Copyright and Related Rights of 4 February 1994 shall apply.

VOLUNTARY CONSENT FOR IMAGE PUBLICATION Those taking part in the photo shoot automatically and voluntarily consent to the publication of their image, their child’s image in Paulina Smile Photography’s portfolio – if you do not give such consent it is essential to provide this information when booking the shoot and to uncheck the relevant boxes in the Mafelo Client panel.

  1. In accordance with the Data Protection Act, consent for the publication of photos is voluntary and cannot be rewarded with discounts, free shots or gifts in kind.
  2. The Client who consents to the publication of the photographs is aware that the images from the shoot may be published on social networks and in the Photographer’s advertising materials for the purpose of documenting the artistic output and promoting the services.
  3. The Client and the shoot participants give irrevocable and perpetual consent to the Photographer to present the photographs featuring the image of the Client / shoot participant / minors, which are the subject of the contract. The Photographer has the right, free of charge, to promote the photographs taken and the image of the Clients for the purpose of presenting his/her work on websites, publications concerning his/her own or collective work, work in folders, and for the purpose of

promotional and advertising activities relating to the Photographer at any time and place throughout the world.

  1. The Parent agrees not to use the photographs taken by the Photographer in photo competitions without prior notice.
  2. I agree to the publication of my image, of the adults and minors taking part in the photo shoot with me for marketing and promotional purposes, by publishing them on the website, via social networks such as facebook, instagram and similar portals, using them in a printed portfolio and making them available to Clients and potential Clients.
